And who is it that really needs an <strong>EU Representative<\/strong>?<\/p>\n\n\n\n<p><strong>The General Data Protection Regulation (GDPR)&nbsp;<\/strong>provides a level of international protection for the personal data of EU citizens under Article 3.<\/p>\n\n\n\n<p>GDPR will apply to companies that are processing EU Citizens outside of the European Economic Area (EEA). GDPR imposes a variety of obligations, such as ensuring that they apply the core <a href=\"https:\/\/seersco.com\/blogs\/how-many-data-protection-principles-are-actually-there\/\">data protection principles<\/a>. And treat the data as is required by the GDPR<\/p>\n\n\n\n<p>To assist with accountability, the GDPR establishes the role of the <strong>EU Representative<\/strong> under Article 27. The role of the EU Representative is a role distinct from that of a <strong><a href=\"https:\/\/seersco.com\/articles\/data-protection-officer\/\">Data Protection Officer<\/a> (DPO)\u00a0<\/strong>for a variety of reasons.<a href=\"https:\/\/seersco.com\/book-eu-representative\"><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What they do?<\/h2>\n\n\n\n<p>The main focus of the <strong>EU Representative<\/strong>&nbsp;is to be the <strong>first point of contact<\/strong> for data subjects and regulators who need to contact the organisation outside of the EEA and<br>to <strong>act in accordance<\/strong> with the instructions that form part of the mandate appointing them.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Top 3 key roles of eU Representative <\/h3>\n\n\n\n<p>In essence, the role of the <strong>EU Representative<\/strong> is a simple one and includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To be the <strong>first point of contact<\/strong> in Europe.<\/li>\n\n\n\n<li>To <strong>receive any complaints and communications<\/strong> in Europe and forward these onto the relevant person within the organisation.<\/li>\n\n\n\n<li>To <strong>liaise between the parties<\/strong> involved with a complaint and provide any assistance when required.<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-gallery aligncenter has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1026\" height=\"997\" data-id=\"806\" src=\"https:\/\/seersco.com\/articles\/wp-content\/uploads\/sites\/2\/2021\/01\/eu-representative.svg\" alt=\"EU Representative\" class=\"wp-image-806\" \/><\/figure>\n<\/figure>\n\n\n\n<p><br><strong>When do you need to appoint an EU Representative?<\/strong><\/p>\n\n\n\n<p>This means that for compliance. Companies that are operating outside of Europe by trying to market. That it must be in the member state that they are offering goods and services. Though in the case where it is being offered across multiple countries in the EEA. They do <strong>allow for the EU Representative <\/strong>to be based in only one of those countries.<\/p>\n\n\n\n<p>This enables companies seeking to appoint one an easier and more cost-effective route. As appointing a representative in every member state would make it costly and increase the complexity of such an operation.<\/p>\n\n\n\n<p>However, the EDPB guidance states that if the subsidiary is not involved with the data processing activity.
